Terms of Service

1. Acceptance of Terms
By creating an account or using Whisper (the "App" or "Service"), operated by Whisper LLC, a Texas limited liability company ("Company", "we", "us"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms include an agreement to resolve disputes by binding arbitration and a class-action waiver (Section 15) where permitted by law.
2. Eligibility
You must be at least 18 years old and legally able to enter into this agreement to use Whisper. By using the Service you represent that you are 18 or older. We may remove any account we believe belongs to a person under 18.
3. Your Account
You are responsible for the accuracy of the information you provide, for keeping your login secure, and for all activity on your account. You agree to provide truthful profile information and not to impersonate anyone or misrepresent your identity or age. One person, one account.
4. Acceptable Use
You agree to use Whisper respectfully and lawfully. You will not: harass, threaten, or abuse anyone; post false, misleading, hateful, sexually exploitative, or unlawful content; share content involving minors; solicit money or promote commercial activity, scams, or fraud; collect other members’ data; use bots or scrape the Service; or interfere with its operation. You are responsible for the content you share and how you interact with others.
5. Zero Tolerance for Objectionable Content & Abuse
Whisper has a zero-tolerance policy for objectionable content and abusive behavior. Content may be moderated, and harassment, hate speech, threats, non-consensual intimate imagery, sexual content involving minors, and other abusive conduct are strictly prohibited. You can report or block any member from their profile or a conversation. We review reports promptly, remove violating content, and remove abusive users. Violations may result in immediate, permanent termination without notice.
6. Safety & No Background Checks
Your safety is your responsibility. We do not conduct criminal background checks or identity verification beyond optional photo verification, and we are not responsible for the conduct of any member, online or offline. Always meet new people in public places, tell a friend where you are going, and never send money to someone you have not met. Use the in-app safety tools, including reporting, blocking, and Share My Date.
7. AI Features
Whisper offers optional AI-powered features, including an assistant, suggested icebreakers, and date ideas. AI output is provided for convenience only, may be inaccurate, and is not professional, legal, medical, financial, or relationship advice. You remain responsible for the content you choose to send and your interactions with others. By using these features you consent to relevant content being processed by our AI provider as described in the Privacy Policy.
8. User Content & License
You retain ownership of the photos, video, voice, text, and other content you submit. By posting content you grant the Company a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely to operate, secure, and improve the Service. You represent that you have all rights necessary to the content you upload and that it does not violate anyone’s rights.
9. Subscriptions, Billing & Cancellation
Whisper offers an auto-renewing Premium subscription. Payment is charged to your Apple ID at confirmation of purchase. Your subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription anytime in your App Store account settings; deleting the app does not cancel it. Prices may vary by region and are shown before purchase. Except where required by law, payments are non-refundable; refund requests are handled by Apple under its policies.
10. Third-Party Services & Purchases
The Service may integrate third-party services (e.g., maps, ride-hailing such as Uber, or restaurant reservations). Your use of those services is subject to their terms, and we are not responsible for them. Any ride vouchers or bookings are provided subject to the applicable provider’s availability and terms.
11. Termination
You may stop using Whisper and delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms, abuse other members, or create risk for the community, and we may remove content that violates our policies. Provisions that by their nature should survive — including content licenses already granted, disclaimers, limitations of liability, indemnification, and dispute resolution — survive termination.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that you will find a match, that the Service will be uninterrupted or error-free, or that any member is who they claim to be.
13. Limitation of Liability
To the fullest extent permitted by law, the Company and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your interactions with other members or your use of the Service. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your interactions with other members, or your violation of these Terms or applicable law.
15. Dispute Resolution, Arbitration & Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Except where prohibited by law, you and the Company agree to resolve disputes through final and binding individual arbitration rather than in court, and you waive the right to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@meetwhisper.app. Nothing in this section prevents either party from seeking injunctive relief or applies where local law grants you non-waivable rights (including certain rights of consumers in India).
16. India-Specific Terms
If you use the Service in India, these Terms are the "terms of service" and this and our Privacy Policy are the "privacy policy" for purposes of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. You agree not to host, display, upload, or share content prohibited under Rule 3(1)(b). You may raise grievances with our Grievance Officer (Settings → Grievance redressal, or grievance@meetwhisper.app); we acknowledge within 24 hours and aim to resolve within 15 days. Nothing here limits your non-waivable rights under Indian law.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email and update the date below. Your continued use of the Service after changes take effect constitutes acceptance.
18. Apple App Store
These Terms are between you and the Company, not Apple. Apple is not responsible for the Service or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use of the Service must also comply with the Apple Media Services Terms and the standard Apple end-user license agreement (EULA).
